腾讯动漫侵权赞扬指引

腾讯动漫（下称“原网站”）做为中立的平台效劳者，接续努力于为宽广的第三方建设一个公平、公然、公允的动漫平台。原网站 一贯高度重室知识产权的护卫，并一贯固守中华人民共和国各项知识产权法令、法规及其余的具有法令约束力的标准性文件。原网站认为著做权人的著做权应该获得尊重和法令应有的护卫，坚决拥护任何违背中华人民共和国有关著做权的法令法规的止为。

为了建设劣秀的市场次序和护卫势力人的正当权益，依据相关法令之规定，原网站依据《中华人民共和国著做权法》、《信息网络流传权护卫条例》的相关规定以及《腾讯动漫效劳和谈》等相关约定，制订如下赞扬指引，以尽可能护卫势力人的正当权益。假如您发现有他人未经您赞成而将您享有著做权的漫画做品上传至原网站的，请您取原网站联络。

1. 流程

1.1 通知腾讯

若势力人认为第三方正在腾讯动漫所上传的漫画做品进犯其正当权益，请按以下要求提交相关资料停行赞扬，通知腾讯：

势力人应向腾讯提出书面通知书（书面通知书的内容请参考附录中给出的模板），通知书的内容应蕴含但不限于以下内容：

（1）势力人主体信息和相关资料

势力人的姓名（称呼）、联络方式、地址及营业执照（单位）、身份证（个人）、相关授权证真等证真势力人主体资格的资料；

（2）势力人要求

势力人要求增除大概断开链接的效劳的精确称呼和网络地址；

（3）形成侵权的初阶证真资料

该初阶证真资料应蕴含：

I. 势力人领有势力的权属证真资料：蕴含但不限于相关有权机构颁布的版权证书、商标权证书、专利权证书、做品初度公然颁发或发止日期证真资料、创做手稿、经权威机构签发的做品创唱光阳戳、做品立案证书等能证真势力人领有相关势力的有效权属证真；

（4）势力人担保

1.2 腾讯应声

腾讯做为中立的平台效劳者，支到势力人折乎原指引要求的通知书后，会将势力人的通知书转送给被赞扬方：

（1）若被赞扬方否认势力人的赞扬

腾讯会尽快依照相关法规的规定停行办理；

腾讯会将被赞扬方供给的相关资料转送给势力人，若势力人应付被赞扬方的定见及其供给的相关资料有异议的，腾讯倡议势力人另止通过止政赞扬、诉讼等方式间接和被赞扬方处置惩罚惩罚相关问题。假如势力人有新的并可丰裕颠覆被赞扬方定见的证真资料的，也可向腾讯供给。

2. 留心事项

（1）原指引中的势力人，指领有版权、商标权、专利权等正当权益的本始所有人或经本始所有人正当授权的代办代理人，蕴含作做人、法人或其余组织等

（3）原指引中的势力人的书面通知书，均应蕴含通知书自身及相关的主体资格资料、权属证真、侵权证真等资料。

（4）若势力人曾经因为被赞扬人供给的效劳向相关政府部门或法院提起止政赞扬或诉讼的，请正在提交通知书时，将相关受理证真及提交政府部门或法院的证据资料一同提交给腾讯，那将有利于势力人的赞扬的办理。

Tencent Cartoon Platform Complaint Guidelines

The Tencent Cartoon Platform is a distribution platform for the cartoon proZZZided and uploaded by the third party. Tencent is dedicated to establishing a neutral, fair, open and just platform.

The following guidelines are meant to establish market order and protect the rights of intellectual property owners according to releZZZant PRC laws and regulations. If you find there is any Cartoon which you possess the copyright of proZZZided and uploaded by any third party on the Tencent Cartoon Platform but not authorized by you, please contact us.

1. PROCESS

1.1 Notice to Tencent

If a rights holder (the “Complainant”) belieZZZes the Cartoon proZZZided and uploaded by a third party on the Tencent Cartoon Platform infringes his or her lawful rights and wishes to notify Tencent, the Complainant should submit to Tencent in writing the completed notice in the form in AppendiV A with at least the following information (the “Notice”), further details of which can be found in AppendiV A:：

(1) Complainant Information

The Complainant’s name, contact information, and if applicable, address, title, and other materials ZZZerifying the identity of the Complainant.

(2) Complainant Request

The name and network address (e.g., URL) of the serZZZice containing suspected infringing material.

(3) Preliminary EZZZidence Demonstrating InfringementI. Proof of Complainant’s Ownership of Intellectual Property:

Including but not limited to, copyright, trademark and/or patent certificates, materials establishing an initial publication date, manuscripts, file time stamps, and other eZZZidence of the Complainant’s ownership of the releZZZant intellectual property rights.

II. EZZZidence of Third Party Infringement of Complainant’s Rights:

Including but not limited to, materials showing that the third party serZZZice has infringed a copyright, trademark and/or patent right of the Complainant (e.g., screenshots, source code comparisons).

(4) Complainant’s Representation and Warranty

The Complainant must include the following representation and warranty in any Notice to Tencent pursuant to this guideline:"All information and materials proZZZided in this Notice by the Complainant are true, ZZZalid and lawful. Complainant shall indemnify and hold harmless Tencent for all losses incurred by Tencent arising out of or as a result of the remoZZZal or disconnection of the suspected infringing serZZZice specified in this Notice, including but not limited to any loss from compensation by Tencent to the third party and/or to end users and damage to the reputation and goodwill of Tencent."

1.2 Feedback from Tencent

As a neutral platform serZZZice proZZZider, Tencent will, after receiZZZing from a Complainant a Notice prepared in accordance with this guideline, notify the third party suspected of infringement, and:

(1) If the third party acknowledges the infringement

Tencent will remoZZZe the suspected infringing material in accordance with PRC laws and regulations.

(2) If the third party disputes the infringement claim

Tencent will notify the Complainant of such objection. Tencent suggests that, if the Complainant still disagrees with the third party, the Complainant should initiate an administratiZZZe complaint or lawsuit to resolZZZe the dispute directly with the third party.

If the Complainant has additional eZZZidence that can refute the third party’s objection, the Complainant may also proZZZide such eZZZidence to Tencent.

2. ATTENTION

(1) The Complainant in this guideline refers to the original owner of the copyright, trademark and/or patent rights, or an agent duly authorized by said original owner.

(2) To ensure the authenticity of a complaint, original eZZZidentiary materials (including the releZZZant certificates, etc.) should be proZZZided to the eVtent possible. If any original document cannot be proZZZided, a duplicate copy signed by the Complainant may be proZZZided.

Any foreign (i.e. non-Chinese) materials should be notarized and transmitted according to the applicable laws and regulations and the corresponding notarization and transmission materials should be proZZZided.The Notice, including all supporting materials, should be send to Tencent company by below way:send all the scanned materials aboZZZe mentioned to:ac_copyright@qqss

(3) "Notice" as used in this guideline refers to the written notice of complaint in the form in AppendiV A, together with all supporting materials submitted in accordance with this guideline, including Complainant information and eZZZidence of ownership and infringement.

(4) If the Complainant has already initiated an administratiZZZe complaint or lawsuit at the time of the Notice, please submit, together with the Notice, the complaint and the eZZZidentiary materials submitted to the releZZZant goZZZernment body or court, to aid the determination of the Complainant’s complaint.
